Equal Pay

Equal pay has been an aspect of sex discrimination law for over 40 years, and is incorporated into the Equality Act 2010. However, a significant pay difference between male and female employees still exists. No matter what size your business is you are responsible for treating your employee equally.

What is Equal Pay? Equal pay means that men and women in the same employment performing equal work must receive equal pay. This applies not only to salary, but to all contractual terms and conditions of employment, e.g. holiday entitlement, bonuses, pay and reward schemes, pension payments and other benefits.

Although the law on equal pay may seem complicated, its purpose is simple – it is to ensure that women and men doing equal work receive equal pay for it. If you are not complying with your legal obligations on equal pay this can leave you open to the risk of an equal pay claim. It is important to note that the legislation protects men and women equally – so it applies just the same if a man is being paid less than a woman for equal work.
